ServicePal SMS Consent Policy
Effective Date: April 6, 2026
Important: This policy explains how ServicePal collects consent to send appointment-related text messages. By providing your phone number and verbal consent during your call, you agree to receive informational SMS messages as described below.
1. How We Collect Consent
Consent Method: Verbal opt-in during phone call
Process:
- You call a business that uses ServicePal's AI answering service
- Our AI assistant (Aria) answers your call and helps you schedule an appointment
- After booking, Aria asks: "Can we send you a text message confirmation of your appointment?"
- You must verbally say "yes" or affirmatively agree to provide consent
- If you say "no" or don't respond, no SMS messages will be sent
- All calls are recorded and consent is documented
Note: Consent is not required to schedule an appointment or purchase services. You may choose to receive appointment confirmations via email instead.
2. Types of Messages You'll Receive
We only send informational messages related to your service appointments:
- Appointment confirmations (sent immediately after booking)
- Appointment reminders (sent 24 hours before scheduled service)
- Technician arrival notifications (when service provider is on the way)
- Service updates (e.g., delays, rescheduling)
We do NOT send:
- Marketing or promotional messages
- Third-party advertisements
- Unsolicited offers
3. Message Frequency & Costs
Frequency: Message frequency varies based on your appointments. Typically:
- 1 message per appointment (confirmation)
- 1 reminder message (24 hours before)
- 1-2 service updates (if applicable)
Costs: Message and data rates may apply based on your mobile carrier's plan. ServicePal does not charge for SMS messages.
4. How to Opt Out
You can stop receiving text messages at any time:
Text "STOP": Reply STOP to any message from us. You'll receive a confirmation that you've been unsubscribed.
Call the business: Contact the service provider directly and ask to opt out of SMS notifications.
Other keywords: Replying with STOP, CANCEL, END, QUIT, or UNSUBSCRIBE will also opt you out.
Processing time: Opt-out requests are processed immediately. You may receive one final confirmation message acknowledging your opt-out.
5. Help & Support
For assistance with SMS messages:
- Text "HELP": Reply HELP to any message for assistance
- Help message: You'll receive instructions on how to opt out and our contact information
- Questions: Contact the service provider who scheduled your appointment
6. Privacy & Data Protection
How we use your phone number:
- Stored securely in our system
- Used ONLY for appointment-related messages
- Never shared with third parties for marketing
- Retained as long as you have active appointments or until you opt out
Your rights:
- You can request deletion of your phone number at any time
- You can update your contact preferences
- You can review your consent history

7. TCPA Compliance
ServicePal complies with the Telephone Consumer Protection Act (TCPA) (47 U.S.C. § 227) and the FTC's Telemarketing Sales Rule (TSR), as well as the CMS (Wireless) SMS Marketing Guidelines.
- Prior Express Written Consent: Where required by law, we obtain prior express written consent before sending SMS messages. For marketing messages, consent must be in writing signed by the consumer. For informational messages to wireless numbers, we obtain consent in accordance with 47 CFR § 64.1200.
- Informational Messages Only: All messages are transactional/informational related to scheduled services. We do not send marketing, promotional, or advertising messages as defined by the TCPA.
- Opt-Out Compliance: Per 47 CFR § 64.1200(d), we honor all opt-out requests immediately. Stop requests are processed within 10 days and no further messages are sent to opted-out numbers.
- Record Keeping: All consent is recorded and documented with timestamps. Records are maintained for a minimum of four (4) years in accordance with TCPA requirements.
- Time Restrictions: Per 47 CFR § 64.1200(a)(1), no messages are sent before 8:00 AM or after 9:00 PM local time of the recipient.
- Do Not Call Registry: We maintain compliance with the National Do Not Call Registry and honor removal requests.
- Wireless Number Restrictions: We do not send messages to wireless numbers unless consent has been properly obtained in accordance with 47 U.S.C. § 332(d).
- Caller Identification: All messages include accurate caller identification and contact information.
- Third-Party Disclosure: We do not share phone numbers with third parties for marketing purposes under any circumstances.
Consumer Rights: Under the TCPA, consumers have the right to revoke consent at any time, sue for damages for violations, and report violations to the FCC or FTC.
